Welcome to CAROPONS.ART. The terms "we", "us" and "our" refer to Caroline Pons, who publishes and operates this website to offer you, as a visitor or customer, a curated purchasing experience (the "Services").
These Terms of Use, together with any related policies (the "Terms"), describe your rights and responsibilities when using the Services.
By using our Services, you agree to be bound by these Terms and by our privacy policy. If you do not accept these Terms, you must not use the Services.
Section 1 — Access
By accepting these Terms, you represent that you are at least the age of majority in your country of residence. To place an order, you may be asked to provide accurate billing, payment and shipping information.
Section 2 — Our products
We have made every effort to display the artworks as accurately as possible. However, colours and appearance may differ from how they appear on your screen. We reserve the right to remove any product and to limit quantities offered.
Section 3 — Orders
When you place an order, you make an offer to purchase. Caroline Pons reserves the right to accept or refuse your order. Your order is not accepted until we confirm acceptance and process your payment.
Your purchases may be returned or exchanged only in accordance with our refund policy. Purchases are intended for personal use and not for resale.
Section 4 — Prices and billing
For certain destinations or formats, shipping costs are quoted after purchase, based on the delivery address. If the shipping quote does not suit you, you may cancel your order for a full refund.
Prices may change without notice. The price charged will be the one in effect when the order is placed. Payments are processed by a third-party provider (Stripe). You warrant the accuracy of payment information and that you are authorised to use that payment method.
Section 5 — Shipping and delivery
We are not responsible for shipping delays. All delivery times are estimates. Once we hand the artworks over to the carrier, title and risk of loss pass to you.
Section 6 — Intellectual property
All artworks, texts, photographs, videos, graphics, trademarks and logos on the site are the property of Caroline Pons and are protected by French and international copyright law.
You are authorised to use the Services for personal, non-commercial purposes only. You must not reproduce, distribute, modify or create derivative works without our prior written consent. All rights not expressly granted are reserved.
Section 7 — Third-party links
The Services may contain hyperlinks to third-party websites (Stripe, social networks, Google Maps). We are not responsible for their content.
Section 8 — Privacy policy
All personal information collected is subject to our privacy policy.
Section 9 — Feedback
If you submit feedback, you grant us a perpetual, worldwide and royalty-free licence to use it. You warrant that you own all necessary rights.
Section 10 — Errors and inaccuracies
We reserve the right to correct any error, and to change or cancel orders if information is inaccurate, at any time without notice.
Section 11 — Prohibited uses
You may not use the Services for unlawful purposes, to violate our intellectual property rights, to harass others, transmit misleading information, send spam, upload viruses, or interfere with the security features of the site.
Section 12 — Termination
We may terminate your access to the Services at our discretion, at any time and without notice. Provisions relating to intellectual property, limitation of liability, indemnification and governing law will survive.
Section 13 — Disclaimer of warranties
Except as expressly stated otherwise, the Services and products are provided "as is" and "as available", without any express or implied warranty. We do not warrant that your use will be uninterrupted or error-free.

To the extent permitted by law, Caroline Pons will not be liable for any direct, indirect, incidental, punitive, special or consequential damages arising from your use of the Services.

These Terms are governed by French law. Any dispute will be subject to the competent courts, subject to mandatory consumer protection provisions.
